ONLINE STORE PRIVACY POLICY
When using the monkey-gym.com Online Store, the User provides his personal data. This Privacy Policy contains information on the principles of processing the User’s personal data and on the related rights. This document reflects the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

The administrator of Users’ personal data is MAŁPISZON Ltd., running a business under the name: MAŁPISZON Ltd., Łepkowskiego Street 8/31, 31-423 Kraków, Poland VAT Id: 9452239951, REGON: 387566760, hereinafter referred to as the “Seller” and entered in the register of enterprises of the National Court Register kept by the District Court Kraków, XIII Commercial Division of the National Court Register under the number KRS 0000870829, REGON 387566760, VAT Id 9452239951, with share capital in the amount of PLN 50,000.00 fully paid.
2. The User may contact the Data Administrator in the following way:

§ 2 PURPOSE AND LEGAL BASIS FOR THE PROCESSING OF PERSONAL DATA
1. Personal data provided by Users of the monkey-gym.com Online Store, i.e. first name, postal address, e-mail address, telephone number, name and tax identification number of the company are processed:
a) to the extent necessary to establish, shape the content, change, solve and correctly implement services provided electronically
b) in order to fulfill orders placed by Users for products in the assortment of the monkey-gym.com Online Store
c) in order to consider complaints submitted by Users and to return benefits in the event of withdrawal from the Sales Agreement (return of goods)
d) in order to service and ensure the operation of the Customer Account set up by Users in the monkey-gym.com Online Store
e) to handle other notifications or inquiries sent by Users.
2. In each of the above cases, the legal basis for data processing is the willingness to fulfill the Sales Agreement that the User concludes with the monkey-gym.com Online Store when making a purchase.
3. In addition, data on transactions made in the monkey-gym.com Online Store and information from the Customer Account are processed in order to comply with the obligations imposed by law (e.g. by the Accounting Act or tax regulations on issuing and storing invoices and accounting documents) or the obligation to demonstrate compliance with the provisions on the protection of personal data.
4. The Seller also processes the following data based on the legitimate interest of the monkey-gym.com Online Store:
a) Users’ data regarding purchases made by them in order to establish or pursue claims by the Seller, as well as to defend against such claims
b) Users’ data provided in the question, complaint or suggestion in order to answer their questions, complaints or suggestions
c) Users’ data, in order to ensure the security of services provided by the Seller by electronic means, including counteracting possible abuse or fraud.

§ 3 PERSONAL DATA RECIPIENTS
1. The Seller provides Users’ data to entities acting on its behalf, i.e. providers of IT services and solutions, courier companies, entities providing accounting services, public authorities, including courts and proxies, at their justified request, if necessary for the Seller’s defense against claims or for the purpose of pursuing claims by him.
2. The Seller provides Users’ data including (name, surname, order number and value, IP number, e-mail address, telephone number, your customer ID assigned to you by the payment service entity) to the entity handling electronic payments, if the User decides to make a payment through one of the cooperating entities in order to make payment for the Order.
3. The Seller does not intend to transfer Users’ personal data to third countries (ie outside the European Economic Area).

§ 4 PERIOD OF PROCESSING OF PERSONAL DATA
1. The Seller intends to process Users’ personal data for the duration of the Sales Agreement regarding the purchase transaction in the monkey-gym.com Online Store, but this period may be extended by the period of limitation of claims of the User or the Seller, if the processing of these data is necessary to establish or pursue claims, and also in defend against such claims.
2. To the extent that the User’s personal data are processed for the purposes of maintaining and servicing the Customer Account, the Seller intends to process the data until the User resigns from the Customer Account in the monkey-gym.com Online Store. This period may be extended by the limitation period for the claims of the User or the Seller, if the processing of such data is necessary to establish or pursue claims, as well as to defend against such claims.
3. To the extent that the User’s personal data are processed for the purposes of the Seller’s compliance with the obligations arising from the provisions of law (e.g. from the Accounting Act or tax regulations), the Seller intends to process them for the period resulting from such provisions (e.g. in For billing purposes, the User’s data will be stored for 5 years from the end of the calendar year in which the deadline for payment of the tax related to the order or transaction expired).
4. To the extent that the User’s personal data are processed for the purposes of the legitimate interests of the Seller, i.e. establishing and pursuing claims or defending against claims, answering a question, complaint or suggestion of the User, as well as determining the quality of our services, the Seller intends them process for the duration of its legitimate interest (in particular until the expiry of the limitation period for claims), unless the User exercises his right and objects to the processing of this data due to his special situation, and the Seller will not be able to demonstrate the existence of valid legally justified grounds to process this data overriding the rights of the User, or the grounds for establishing, investigating or defending claims.

§ 4 YOUR RIGHTS RELATING TO THE PROCESSING OF PERSONAL DATA
1. In connection with the processing of personal data by the monkey-gym.com Online Store, Users have the following rights:
a) the right to obtain confirmation whether the User’s personal data is being processed, as well as the right to access this data and a copy thereof
b) the right to request that the User’s personal data be corrected or supplemented
c) the right to request the restriction of the processing of the User’s personal data, if, for example, he considers that the processing of his personal data is unlawful
d) the right to request the deletion of the User’s personal data
e) the right to transfer data in a commonly available machine-readable format
f) the right to object to marketing
g) the right to object to the processing of this data for reasons related to the specific situation of the User
h) the right to withdraw consent to data processing
i) the right to withdraw consent to marketing communication
2. To exercise the rights of the User, please contact the Seller at the points provided in § 1 point. 2 contact details. The User may independently edit the personal data provided in the Customer Account (“My Account” tab). The User may also request the Seller to remove the entire Customer’s account by sending an appropriate request to the e-mail address: office@monkey-gym.com from the e-mail address currently registered in the monkey-gym.com Online Store.
3. Complaint to the supervisory body: The user has the right to lodge a complaint with the authority dealing with the protection of personal data (the President of the Personal Data Protection Office) if he considers that the processing of his personal data violates the provisions of the GDPR.

§ 5 CONSEQUENCES OF NOT PROVIDING PERSONAL DATA
1. Providing personal data is voluntary, however, failure to provide some personal data (identity or address data) may prevent the Seller from providing electronic services and making purchases by the User in the monkey-gym.com Online Store. For this reason, providing basic data (User’s identity, e-mail address, postal address) is necessary to make a purchase in the monkey-gym.com Online Store.
2. Failure to provide the data required at the stage of registration of the Customer Account of the monkey-gym.com Online Store will prevent the registration of the Customer Account.

§ 6 SAFETY PRINCIPLES
1. For the sake of security, the User should remember about:
a) establishing a login and password to the Customer Account that make it impossible to easily guess them by third parties
b) logging out of the monkey-gym.com Online Store after completed purchases. Logging out of the monkey-gym.com Online Store will take place after clicking the “Log out” button, which is located in the upper right corner of the monkey-gym.com Online Store
c) keeping the login and password to the Customer Account secret, including in particular not transferring data (login, password) to any third parties
d) using anti-virus programs, including regular scanning of disks for viruses
e) using the monkey-gym.com Online Store only through trusted computers on which only proven software has been installed. Using someone else’s computers creates a risk of intercepting your login, password or other data you provide

§ 7 TECHNICAL INFORMATION – COOKIES
1. When the User uses the monkey-gym.com Online Store, small files containing information necessary for the proper use of the monkey-gym.com Online Store are saved on the User’s device, the so-called cookies. By saving these files on the User’s device, it is possible, among others. remembering login details or remembering goods added to the basket.
2. Cookies are in no way harmful to the User’s device and do not change its settings or the settings of the software installed on it. Reading the content of these files is possible only by the server that created them. 3. Permanent files are stored on the User’s device for the time specified in the parameters of these files or until they are deleted.

5. If the User does not consent to the storage of cookies on his device, he must change the settings of his web browser accordingly. 6. In order to protect personal data, the Seller uses an encrypted connection. Only persons authorized by the Data Administrator have access to the database of the Users of the monkey-gym.com Online Store.

§ 7 FINAL PROVISIONS
1. This Privacy Policy is valid from May 25, 2018.
2. Due to the constant development and progress of technology, the rules set out in the Privacy Policy may change. The Seller will inform the Users about the change of these rules in advance, no later than 7 days before their introduction, by posting the new content of this document on the website https://monkey-gym.com/terms-and-conditions/
